नूराकुश्ती

आज हाल फिलहाल के भारतीय राजनीति की सबसे बड़ी नूरकूश्ति होनेवाली है. इस कुश्ती के चार मुख्य पहलवान है-

पहला- भ्रस्टाचार.

दूसरा- अपने नेता.

तीसरा- देश.

चौथा- हमलोग यानी आमजनता.

लेकिन एक बात तो पक्का है कि फाइनल मुकाबला नेता और भ्रस्टाचार के बीच ही होनी है क्यूकी दोनो बड़े खिलाड़ी है और मजबूत भी, साथ मे बहुत गहरा रिश्ता है. दोनो चाहते है की हमेशा मुक़ाबला इन्ही के बीच हो, जो पहले से फिक्स जैसा दिखता है. इनमे से जीते भले कोई पर फ़ायदा दोनो को होगा. ये दोनो खिलाड़ी बड़े प्रेम से एक साथ रहते है. केवल दिखाने के लिए लड़ते है कि देखो तमाशा की कैसे अपन लड़ते है.

आह..! कितनी सुंदर लड़ाई लड़ते है, किसी को नुकसान ही नही पहुचाते है. भ्रस्टाचार और नेता से हमे सीख मिलती है की कैसे प्रेम से रहा जाए साथ मिलकर, फोकट मे अपन लड़ते रहते है.

पर लोकपाल के आखाड़े मे होने वाली आज की कुश्ती मे अगर नेता या भ्रस्टाचार जीता तो ये देश की आम जनता और देश की हार होगी. दुआ करे उपर वाले से की हमारे नेताओ को थोड़ी मजबूत निर्णय शक्ति दे जिससे एक असरदार लोकपाल बन सके. और हम भ्रस्टाचार जैसे खिलाड़ी को हमेशा के लिए टूर्नामेंट से बाहर कर दे. पर इसमे थोड़ा शक़ है क्यूकी कोई भी मुजरिम अपने लिए तो फाँसी का फंदा तो तैयार नही करता.

तो देखे आज की कुश्ती, हमलोग तो केवल तमाशा ही देख सकते है अभी, कारण आम चुनाव अभी दूर है।

लोकपाल बिल पर गलतफहमियां

पहला मुद्दा: मजबूत लोकपाल बिल
जन लोकपाल एक ‘भस्मासुर’ है। कुछ जगह ऐसा बताया गया है कि मजबूत लोकपाल लोकतंत्र के लिए खतरा है। कई लेखों में कुछ लोगों ने जांच की ताकत, समन, फोन टैपिंग, उपेक्षित सत्ता आदि को लेकर सवाल उठाए हैं।

हमारा जवाब: क्या हम कमजोर लोकपाल बनाना चाहते हैं? ऊपर गिनाए गए अधिकार वे हैं जो किसी भी कानून प्रवर्तन और जांच एजेंसी के पास होते हैं जैसे कि ईडी (प्रवर्तन निदेशायल), सीबीआई, इनकम टैक्स आदि। ऐसी कोई ताकत नहीं है जो इनके पास न हो और हम उसे लोकपाल को देने के लिए कह रहे हैं। लोकपाल इन अधिकारों के बिना कैसे काम करेगा? लोकपाल से यह अपेक्षा नहीं की जा सकती कि वह राजा, कलमाड़ी और येदियुरप्पा जैसे लोगों के सामने हाथ बांध कर खड़ा रहे और उनसे उनके ही गलत कामों का और अवैध संपत्ति का खुलासा करने के लिए कहे।

भ्रष्ट लोग कमजोर लोकपाल बिल चाहते हैं। निश्चित ही ऐसे सवाल पूछने वाले लोग अच्छी भावना होने के बावजूद कमजोर लोकपाल बिल का समर्थन कर अनजाने में भ्रष्ट लोगों का हित साध रहे हैं। हमारे पास पर्याप्त निगरानी के साथ एक मजबूत लोकपाल बिल होना चाहिए जिससे कि लोकपाल द्वारा अधिकारों के गलत इस्तेमाल को रोका जा सके। अगर हम ऐसी निगरानी प्रणाली बनाने में असफल रहते हैं तो कृपया इन्हें बनाने में हमारी मदद कीजिए।

दूसरा मुद्दा: लोकपाल का अधिकार क्षेत्र
न्यायपालिका को लोकपाल के तहत नहीं लाया जाना चाहिए। लोकपाल को केवल राजनेताओं में भ्रष्टाचार से निपटना चाहिए न कि अफसरशाहों से।

हमारा जवाब: करप्शन के खिलाफ पूरे देश में फैला गुस्सा न्यायपालिका के करप्शन के खिलाफ भी है। इसलिए हम चाहते हैं कि न्यायपालिका में फैले करप्शन से भी अभी ही निपटा जाए। भारत के कुछ पूर्व न्यायाधीशों समेत कुछ लोगों ने सुझाव दिया है कि इसे जुडिशल स्टैंडर्ड्स ऐंड अकाउंटेबिलिटी बिल के जरिए किया जाना चाहिए। हमें इससे कोई दिक्कत नहीं है अगर यह बिल जन लोकपाल बिल के साथ पारित होता है। लेकिन सरकार द्वारा तैयार किया गया ड्राफ्ट बिल बहुत खराब है। इस बिल पर अभी तक जनता से राय लेना शुरू नहीं किया गया है। सरकार द्वारा तैयार किए गए ड्राफ्ट बिल में कई मुद्दों को सुलझाने की जरूरत है। यह पता नहीं है कि एक बढ़िया जुडिशल ऐंड अकाउंटेबिलिटी बिल को यथार्थ रूप लेने में कितने साल लगेंगे। तो क्या न्यायपालिका में फैले भ्रष्टाचार के मुद्दे को तब तक के लिए टाल दिया जाना चाहिए?
यह कहा जा रहा है कि लोकपाल को केवल राजनेताओं के भ्रष्टाचार से मतलब रखना चाहिए। यूपीए बिल्कुल यही चाहती है। यूपीए ने अपने ड्राफ्ट बिल में यही मॉडल सुझाया है। यही मॉडल कई राज्यों में लोकायुक्त के स्तर पर मौजूद है और यह पूरी तरह से असफल हो चुका है। क्या लोकपाल को अफसरशाही में फैले भ्रष्टाचार से भी नहीं निपटना चाहिए? शायद ही कोई करप्शन राजनेताओं के लेवल से शुरू होता हो। ज्यादातर यह किसी अफसर के लेवल से शुरू होता है जो संभवत: किसी दबाव में फाइल पर कुछ लिखता है। किसी फाइल पर नेता का रोल कई लेवल बाद आता है। यही कारण है कि लोकायुक्त तक कोई केस नहीं पहुंचता। दिल्ली लोकायुक्त का अधिकार क्षेत्र नेताओं तक सीमित है। दिल्ली के पूर्व लोकायुक्त जस्टिस शमीम ने अपने एक इंटव्यू में शिकायत की थी कि सरकार उनके संस्थान के ऊपर सवा करोड़ रुपये सालाना खर्च करती है और उन्हें हर साल कार्रवाई लायक 5 शिकायतें भी नहीं मिलतीं। कर्नाटक में लोकायुक्त के अधिकार क्षेत्र में नेता और अफसरशाह दोनों शामिल हैं और यह बढ़िया काम कर रहा है। सभी लोकायुक्तों की सालाना कॉन्फ्रेंस में कई सालों से यह मांग की जाती रही है कि केवल नेताओं तक सीमित उनके आधे-अधूरे अधिकार भ्रष्ट लोगों का हित साधते हैं और इसे तुरंत ठीक किया जाना चाहिए। वे कर्नाटक के मॉडल को पूरे देश में लागू करने की मांग करते रहे हैं। राजनीतिक इच्छाशक्ति में कमी की वजह से इसे अब तक नहीं किया गया। मुझे विश्वास है कि कोई भी ऐसा सुझाव देना नहीं चाहेगा जो अनजाने में करप्ट लोगों का हित साधता हो।

तीसरा मुद्दा: लोकपाल की आंतरिक निगरानी- लोकपाल से भ्रष्टाचार को दूर रखने के लिए उठाए गए कदम

हमारा जवाब: यह बहुत महत्वपूर्ण मुद्दा है। यह हमारे लिए बहुत ध्यान देने का विषय है। हमें कई बढ़िया विचार मिले हैं। लोकपाल को उत्तरदायी बनाने के लिए कुछ उपाय निम्न हैं:
1- कैग लोकपाल का वित्तीय और कामकाज का सालाना ऑडिट करेगा।
2- उपयुक्त संसदीय समिति लोकपाल का सालाना मूल्यांकन करेगी।
3- कंप्लेंट्स अथॉरिटी का सिस्टम (पुलिस रिफॉर्म्स की तर्ज पर) जिसमें सिविल सोसायटी से लोग शामिल होंगे। अगर स्थानीय सतर्कता अधिकारी करप्शन में शामिल हैं तो ये उन्हें हटाने का काम करेंगे। कंप्लेंट्स अथॉरिटी की सुनवाई खुले में होगी। एक राज्य में एक या ज्यादा कंप्लेंट्स अथॉरिटी हो सकती हैं।
4- लोकपाल सदस्यों के खिलाफ शिकायत सुप्रीम कोर्ट में शिकायत की जा सकेगी।
5- हम अभी भी लगातार सोच-विचार रहे हैं कि हाई-प्रोफाइल केस को देख रहे जांच अधिकारियों की जवाबदेही किस तरह से सुनिश्चित की जाए। क्या लोकपाल सदस्यों को उनकी शिकायतें देखनी चाहिए? लेकिन इससे लोकपाल सदस्यों के पास बहुत सी शिकायतें हो जाएंगी। क्या केवल कंप्लेंट्स अथॉरिटी को इन्हें देखना चाहिए? कृपया हमें कुछ और सुझाव दीजिए।
6- लोकपाल की कार्य-पद्धति में आंतरिक पारदर्शिता भी लोकपाल के भीतर कुछ गलत होने से रोकेगी।
7- लोकपाल के कई स्तरों पर रेग्युलर सोशल ऑडिट।
लोकपाल/लोकायुक्त को स्वतंत्र, निष्पक्ष और करप्शन से ऊपर रखने के लिए ज्यादा विचार और सुझाव की जरूरत है।

चौथा मुद्दा: लोकपाल को केवल ऊंचे स्तर के करप्शन से मतलब रखना चाहिए। वरना इनके पास शिकायतों का अंबार लग जाएगा और ये उससे निपट नहीं पाएंगे।

हमारा जवाब: लोकपाल को लेकर हमारा नजरिया अलग-अलग है। कुछ लोग लोकपाल के सदस्यों और अध्यक्ष को जांचकर्ता की तरह देखते हैं, जो ज्यादा केस नहीं संभाल पाएंगे। इसलिए वे सुझाव देते हैं कि लोकपाल को केवल हर साल कुछ हाई प्रोफाइल केस ही देखने चाहिए।

इससे अलग हम इसे करप्शन की रोकथाम को सुनिश्चित कर सकने में सक्षम विस्तृत ऐंटिकरप्शन सिस्टम की तरह देखते हैं। फिलहाल हमारे देश में ऐसा कोई सिस्टम मौजूद नहीं है। लोकपाल सदस्य किसी भी केस को सीधे डील नहीं करेंगे। उनके पास एक तंत्र होगा जिसके तहत केस डील किए जाएंगे। हाई प्रोफाइल केस को देखने के लिए उनके सीधे नियंत्रण में कुछ स्पेशल जांच यूनिट होंगी। लेकिन बाकी तंत्र द्वारा छोटे केस देखे जाएंगे।

उदाहरण के लिए यह कहना गलत होगा कि सेंट्रल बोर्ड ऑफ डायरेक्ट टैक्सेस (सीबीडीटी) के चेयरमैन को 3 करोड़ टैक्सदाताओं के टैक्स रिटर्न का उत्तरदायित्व नहीं देना चाहिए क्योंकि उनका काम बहुत बढ़ जाएगा और वह हाई प्रोफाइल टैक्सचोरों को नहीं पकड़ पाएंगे। लेकिन वह खुद किसी व्यक्ति के टैक्स रिटर्न को डील नहीं करते हैं। उनके तहत एक बड़ा तंत्र काम करता है। ऐसे ही यह कहना गलत होगा कि सीबीआई के डायरेक्टर के पास करप्शन की शिकायतों का ढेर लग गया। सीबीआई के पास 1600 से ज्यादा जांच अधिकारी हैं। सीबीआई के डायरेक्टर व्यक्तिगत रूप से खुद न तो शिकायत लेते हैं और न ही जांच करते हैं।

इसी तरह लोकपास अध्यक्ष या सदस्य खुद शिकायतें प्राप्त नहीं करेंगे। लोकपाल के कई स्तरों पर शिकायतें प्राप्त की जाएंगी और उनकी जांच की जाएगी। क्या इससे लोकपाल का आकार बहुत बढ़ जाएगा? नहीं, हमारे अनुमान के मुताबिक लोकपाल के तहत काम करने वाले लोगों की संख्या 15000 से ज्यादा नहीं जाएगी जो कि किसी औसत सरकारी विभाग जितना ही है।

अगर लोकपाल केवल ऊंचे स्तर के करप्शन से निपटेगा तो नीचे स्तर के करप्शन से कौन निपटेगा?

कई लोग कहते हैं लोकपाल करप्शन को दूर करने के लिए पर्याप्त नहीं है। करप्शन को दूर करने के लिए अलग-अलग स्तरों पर कई ऐडमिनिस्ट्रेटिव सुधारों की जरूरत है। हम इससे पूरी तरह सहमत हैं। हम यह कतई नहीं कह रहे हैं कि लोकपाल से करप्शन दूर हो जाएगा। जन लोकपाल करप्शन से केवल बचाव का साधन बनेगा। इससे भ्रष्टाचारियों के दिमाग में एक डर बैठेगा कि अगर वे करप्शन में शामिल हुए तो उन्हें सजा मिल सकती है। यह ऐसी संस्था है जहां कोई नागरिक करप्शन के खिलाफ शिकायत कर सकता है और उस पर ईमानदारी से जांच की जाएगी। अगर हम लोकपाल को केवल हाई लेवल करप्शन तक सीमित कर देते हैं तो आम लोग कहां जाएंगे? आरटीआई के जरिए सरकारी योजनाओं में करप्शन का खुलासा कौन करेगा? और हाई लेवल करप्शन की परिभाषा कैसे तय होगी?

और अगर लोकपाल हाई लेवल करप्शन को डील करेगा तो क्या ट्रिकल डाउन इफेक्ट से नीचे का करप्शन अपने आप कम हो जाएगा? जिस तरह आर्थिक सुधारों में ट्रिकल डाउन इफेक्ट नहीं था, उसी तरह टॉप के लोगों के खिलाफ ऐंटिकरप्शन सिस्टम बनाने का कोई ट्रिकल डाउन इफेक्ट नहीं होगा। अनुभव बताते हैं कि टॉप पर बैठे ईमानदार लोग अपने विभागों में निचले स्तर पर करप्शन को कम नहीं कर सकते।

मूर्खता का उबाल या दूरगामी चाल .......?

बाबा रामदेव को पुलिस ने आधी रात के बाद उठा लिया और ज़ोर-ज़बरदस्ती के बल पर पंडाल खाली करा दिया। मीडिया वाले चकित हैं कि सरकार ने आखिर ऐसा क्यों किया। आम राय यही है कि यूपीए सरकार का यह कदम कांग्रेस और उसकी सहयोगी पार्टियों के खिलाफ ही जाएगा। क्या यह विनाशकाले विपरीत बुद्धि का परिचायक है? हो सकता है। लेकिन मानने को मन नहीं करता कि जिस कांग्रेस में इतने घाघ भरे पड़े हैं, वे अपनी कब्र खुद ही खोदने वाला ऐसा कदम बिना सोचे-समझे उठाएंगे।

बाबा का अनशन शुरू होने से पहले ही सरकार के मंत्री जिस तरह उनसे चर्चा कर रहे थे, उससे यही लग रहा था कि यह अनशन ज्यादा लंबा नहीं चलेगा। लेकिन यह भी पता था कि अगर सहमति हो गई तो भी अनशन शुरू तो ज़रूर होगा। चूंकि अनशन का प्रोग्राम बहुत पहले से बन गया था, रामलीला मैदान में हजारों की भीड़ इकट्ठा होना भी तय था, मीडिया भी इसको टीआरपी की ही खातिर रात-दिन दिखाएगा, यह भी मालूम था – इसलिए इसकी उम्मीद कम थी कि बाबा सरकार द्वारी मांगें मान लिए जाने के बावजूद राष्ट्रीय लाइमलाइट में आने का यह सुनहरा मौका छोड़ देंगे।

शनिवार शाम तक उम्मीद थी कि सरकार बाबा की विभिन्न मांगों पर कुछ कमिटियां बनाने का लिखित वादा करके मामले को अस्थायी तौर पर निपटा देगी। बाबा भी बार-बार यह घोषणा कर रहे थे कि वह सरकार गिराने के लिए यह अनशन नहीं कर रहे। उन्होंने यह भी कहा कि अगर सरकार ने उनकी मांगें मानीं तो वह सरकार को भी श्रेय देंगे। लेकिन कहीं कुछ ज़रूर हुआ इस बीच जिसने दोनों पक्षों के बीच हो रही सहमति का पुल तोड़ दिया। सरकार ने वह गोपनीय चिट्ठी जारी कर दी जिसमें बाबा के सहयोगी ने वादा किया गया था कि शाम तक बाबा अनशन तोड़ देंगे। इसके बाद बाबा भी भड़क गए कि सरकार ने उनसे धोखा किया। फिर आधी रात को जो हुआ, वह हम सब जान ही गए हैं।

आज या कल में सरकार की तरफ से बताया जाएगा कि वह यह सब करने के लिए 'मजबूर' क्यों हुई। वह शायद यह कहे कि हमने बाबा की सारी वाजिब मांगें मान ली थीं और गैरवाजिब मांगें (जैसे भ्रष्टाचार के लिए फांसी की सज़ा आदि) नहीं मानी जा सकतीं। सवाल पूछा जा सकता है कि क्या 100 रुपए लेने पर किसी पुलिसवाले को मृत्युदंड दे दिया जाएगा?

सरकार उनकी मांगों को मानने वाली चिट्ठी भी जारी कर दे और अगले कुछ दिनों में उनके उठाए मुद्दों पर कमिटियां भी बना दे। हम जानते हैं कि किसी भी मामले से ध्यान हटाने या उसको लटकाने के लिए कमिटी बनाना हमारी सरकारों का पुराना धंधा है। अगर रिपोर्ट देने के लिए कोई टाइम तय कर भी दिया तो वह हर तीन या छह महीने के बाद बढ़ाया जा सकता है। और अंततः कमिटी की रिपोर्ट को माना जाए, यह भी बाध्यता नहीं। शुंगलू कमिटी के मामले में हम देख ही रहे हैं।

तो सारी उम्मीद थी कि सरकार बाबा रामदेव को बहला-फुसला लेगी और रामदेव भी बहल-फुसल जाएंगे। इसमें दोनों पक्षों का फायदा होगा – रामदेव अपने-आप को राष्ट्रीय राजनीति में प्रोजेक्ट भी कर लेंगे और सरकार पर से आया संकट भी टल जाएगा।

लेकिन जो हुआ, वह इसके उलट हुआ। सरकार की किरकिरी हुई और रामदेव और बड़े हीरो बन गए। क्या सरकार को यह मालूम नहीं था कि वह जो कर रही है, उससे रामदेव को ही फायदा होगा?

या कहीं यह इसीलिए तो नहीं हो रहा है कि सरकार चाहती है कि रामदेव को हीरो बनाया जाए, उनका गुस्सा बढ़ाया जाए, इस गुस्से की आग में उनका कद और उनकी महत्वाकांक्षा बढ़ाई जाए। इतनी बढ़ाई जाए कि वह खुद को अगले प्रधानमंत्री के रूप में देखने लगें और इस दिशा में अपनी पार्टी बना लें, चुनाव लड़ें। अब आप सोच ही सकते हैं कि अगर रामदेव के मन में यह इच्छा जग गई (क्या जानें, पहले से जगी हुई हो) तो उनके इस कदम से किसको फायदा और किसको नुकसान होगा?

ज़रा गहराई में जाएंगे तो साफ हो जाएगा कि रामदेव को हीरो बनाने से कांग्रेस को ही फायदा है और नुकसान है बीजेपी को। बीजेपी और आरएसएस आज भले ही बाबा रामदेव का खुला समर्थन कर रहे हों लेकिन अंदर ही अंदर उनको यह डर भी है कि कहीं बाबा की राजनीतिक महत्वाकांक्षा जाग गई तो उनके ही वोट कटेंगे। बाबा महात्मा गांधी नहीं हैं कि नेहरू को सत्ता दिला दी, खुद उससे दूर रहे, न वह जयप्रकाश नारायण हैं जिन्होंने 1977 में जनता पार्टी की सरकार बनवाई थी लेकिन खुद कोई पद नहीं लिया। बाबा रामदेव राजनीति में आएंगे तो ऐक्टिवली आएंगे, कुछ करने और कुछ पाने के लिए आएंगे। वह कोई शत्रुघ्न सिन्हा नहीं हैं बीजेपी के टिकट पर एक लोकसभा सीट या छोटा-मोटा मंत्रिपद लेकर संतुष्ट हो जाएं। वह तो चाहेंगे कि जैसे एन.टी. रामाराव ने 1982 में आंध्र प्रदेश में अपने बल पर तेलुगू देशम पार्टी बनाई और कांग्रेस को उखाड़ फेंका, वैसे ही वह भी ऐसी पार्टी बनाएं जो अपने बल पर सत्ता में आने की ताकत रखती हो। वह चाहेंगे कि उनके लोगों को ज्यादा से ज्यादा सीटें मिलें। उनकी यह मांग, उनकी महत्वाकांक्षा सालों से पार्टी के लिए काम कर रहे और सत्ता में आने का सपना देख रहे बीजेपी-संघ के नेताओं को क्यों और कैसे पच सकती है? वह जो देश में रामराज्य लाने का नारा देते हैं, वह रामदेव का राज लाने के लिए थोड़े ही है!

कांग्रेस का यह पुराना तरीका है। पंजाब में उसने अकाली दल को पीटने के लिए भिंडरांवाले को शह दी लेकिन अंततः यह उसके और देश के लिए नुकसानदेह साबित हुआ। अब लगता है कि बीजेपी के वोट काटने के लिए ही रामदेव को हीरो बना रहे हैं। यह चाल कितनी कामयाब होगी, अभी से कहना मुश्किल है। सबकुछ रामदेव के अगले कदम पर निर्भर करता है। खेल अभी खत्म नहीं हुआ है, बल्कि शुरू हुआ है। कह सकते हैं कि 'राम से राज तक' नामक मूवी का टाइटल सीन चल रहा है। हो सकता है, रामदेव हरिद्वार से ही अपना अनशन जारी रखने की घोषणा करें। तब क्या होगा? क्या कांग्रेस के घाघ शकुनियों ने इसके बारे में भी कुछ सोचा है?

Much has been made of my personal contest with Tendulkar. 1.An institution called LOKPAL at the centre and LOKAYUKTA in each state will be set up

2.Like Supreme Court and Election Commission, they will be completely independent of the governments. No minister or bureaucrat will be able to influence their investigations.

3.Cases against corrupt people will not linger on for years anymore:

Investigations in any case will have to be completed in one year.
Trial should be completed in next one year so that the corrupt politician, officer or judge is sent to jail within two years.

4.The loss that a corrupt person caused to the government will be recovered at the time of conviction.

5.How will it help a common citizen: If any work of any citizen is not done in prescribed time in any government office, Lokpal will impose financial penalty on guilty officers, which will be given as compensation to the complainant.

6.So, you could approach Lokpal if your ration card or passport or voter card is not being made or if police is not registering your case or any other work is not being done in prescribed time. Lokpal will have to get it done in a month’s time. You could also report any case of corruption to Lokpal like ration being siphoned off, poor quality roads been constructed or panchayat funds being siphoned off. Lokpal will have to complete its investigations in a year, trial will be over in next one year and the guilty will go to jail within two years.

7.But won’t the government appoint corrupt and weak people as Lokpal members?
That won’t be possible because its members will be selected by judges, citizens and constitutional authorities and not by politicians, through a completely transparent and participatory process.

8.What if some officer in Lokpal becomes corrupt?
The entire functioning of Lokpal/ Lokayukta will be completely transparent. Any complaint against any officer of Lokpal shall be investigated and the officer dismissed within two months.

9.What will happen to existing anti-corruption agencies?
CVC, departmental vigilance and anti-corruption branch of CBI will be merged into Lokpal.

Lokpal will have complete powers and machinery to independently investigate and prosecute any officer, judge or politician.

Here is a prediction for 2011: Possibly the greatest scandal in Indian governmental history is likely to die a death by 1,000 technicalities.

The 2G scam, which cost the country as much as $40 billion in lost potential revenue because of the way the 2008 telecom spectrum allotment was handled, appears to be receding from the public consciousness. Turns out there is nothing like the intricacy of Parliamentary procedure to dull the sense of fiery outrage.

And that, it appears, is exactly what Congress wants: To produce enough process-babble and apparent intra-party squabbling to steal the headlines and feed the news mill. It’s sort of the political equivalent of anti-aircraft flak, a way to confuse and throw off course those who would drop bombs.

How else to explain this sequence of events? Prime Minister Manmohan Singh offers to appear before the Public Accounts Committee—an apparently genuine offer to explain and take responsibility as well as a gambit that appearing before that committee will negate the chief opposition demand by the Bharatiya Janata Party of a joint parliamentary probe.

Fortuitously, Murli Manohar Joshi, chairman of the accounts committee, then claims he has, in effect, just as much ability to get to the bottom of this as a joint parliamentary probe. This was the equivalent of friendly fire, since Mr. Joshi is a member of the BJP.

But suddenly Finance Minister Pranab Mukherjee makes the extraordinary statement Sunday that he would not have advised Mr. Singh to offer to appear before the Public Accounts Committee had he been consulted. He argued that the Prime Minister is answerable to the whole House and not a committee of it.

Excuse me, who is in charge here? In a government that runs along the usual lines of authority, that statement would have elicited a stern rebuke from the boss and, possibly, offers of resignation from the offending Cabinet member for his impertinence.

Instead, Mr. Mukherjee employed the oldest of political tricks and insisted—in later clarifying remarks—that there was no difference of opinion between him and the PM, knowing full well that this would be the sixth or seventh paragraph in news stories about his initial remarks.

But the point is this: The papers are now talking about why the ruling Congress Party doesn’t agree on Mr. Singh’s offer and the debate over how best to investigate government corruption is being steered in another direction. Why else raise the specter of a hearing by the “whole house”?

The suggestion that any hearing that involves only part of the lower house is inappropriate is a clever sideswipe at the BJP’s chief demand. And the opposition party risks looking a bit stale if it keeps harping on the joint parliamentary probe. That could also force the BJP to think about whether it really wants to continue to use that demand as a lever to disrupt the budget session in February as well.

Mahesh Rangarajan, a political analyst and professor of History at University of Delhi says, “Mr. Mukherjee’s comments might be a new political ploy to play on the divisions in the opposition Bharatiya Janata Party.”

Political sympathies can shift quickly when parties appear to be holding up the functioning of government, as the Republicans in the U.S. found out to their great cost in a budget showdown with then-President Bill Clinton in 1995. It marked the beginning of Mr. Clinton’s political comeback.

We don’t, however, foresee the same sort of resurrection for Mr. Singh, who doesn’t appear to be in the mood to reassert himself by stating that the Finance Minister was out of line to publicly question his offer. He had the chance this morning, in his first public address of the year, when speaking at a science conference in Chennai. Instead, this is what he said.
The university system, we might note, would have benefited greatly from some of the $40 billion his government had the chance to earn but blew three years ago.
